By placing an order with Cement Tile Shop, the purchaser acknowledges and agrees to the following Terms of Sale. Please review these terms, our Shipping & Return Policy, Frequently Asked Questions, and applicable Installation Guidelines before ordering or installing material.
Product Appearance & Natural Variation
Many products sold by Cement Tile Shop are handmade, made from natural materials, or produced using processes that naturally create variation. Cement tile, zellige, terrazzo, marble, natural stone, breeze block, mosaics, and other products may vary in color, shade, tone, texture, dimensions, thickness, veining, aggregate, surface finish, edges, and overall appearance.
Handmade tile in particular will not be identical from piece to piece. Variations may include irregular edges, minor chips, pits, surface texture, tonal differences, fine cracks or crazing, and other characteristics associated with handmade production. These characteristics are generally part of the intended appearance of the material and are not necessarily product defects.
Natural stone products, including marble, will vary in color, veining, pattern, mineral content, and surface characteristics. No two pieces of natural stone should be expected to be identical.
Color and appearance may also change naturally over time as material is installed, cleaned, maintained, sealed, exposed to light and moisture, and subjected to normal wear.
Samples, Photographs & Product Representation
Samples and website photographs are intended to represent the general appearance of a product but cannot guarantee the exact color, shade, texture, veining, pattern placement, or other characteristics of material received in a future order. Production batches and natural materials can vary.
Computer monitors, mobile devices, lighting conditions, photography, and image processing may also affect how colors appear. Customers who are concerned about color, texture, finish, or other characteristics are strongly encouraged to request and review a current sample before placing an order.
Cement Tile Shop is not responsible for samples or product representations supplied by unrelated manufacturers, dealers, contractors, designers, local showrooms, or other third parties.
Ordering Quantities & Additional Material
Customers are responsible for confirming project measurements and required quantities with their installer or contractor. Additional material should be ordered to allow for cuts, layout, installation waste, future repairs, and the natural variation inherent in many tile products.
An additional 10%–15% is commonly used as a starting point for tile projects, but the appropriate amount may vary depending on the product, installation pattern, room layout, cuts, project conditions, and installer requirements.
We strongly recommend ordering all material needed for a project at the same time. Material ordered later may come from a different production batch and may not match the original material in color, shade, size, texture, or other characteristics.
During installation, material should be blended from multiple cartons as appropriate for the particular product.
Inspection Before Installation
Customers and installers must inspect the entire order before cutting or installing material. Confirm the product, pattern, color, quantity, dimensions, and overall appearance, and identify any visible damage or other concerns before installation begins.
If you believe that material is incorrect, damaged, defective, or otherwise unsuitable, stop and contact Cement Tile Shop before cutting or installing the material.
Installation of material constitutes acceptance of visible characteristics that reasonably could have been identified before installation. Claims relating to visible color, shade, pattern, size, finish, quantity, or other apparent conditions must be made before the material is cut or installed.
Cement Tile Shop is not responsible for installation labor, removal, reinstallation, setting materials, or related project costs resulting from material that was installed after a visible issue reasonably should have been identified.
Installation & Project Responsibility
Installation information provided by Cement Tile Shop is intended as general guidance. Project conditions, substrates, moisture conditions, waterproofing requirements, movement joints, setting materials, grout, sealers, building codes, and other installation requirements vary.
Customers should use a qualified professional installer familiar with the material being installed. The purchaser and installer are responsible for determining whether the selected product and installation system are appropriate for the specific application and jobsite conditions.
Always follow the current instructions from the manufacturers of mortars, adhesives, waterproofing systems, grout, sealers, cleaners, and other installation products being used, together with applicable building codes and recognized industry practices.
Cement Tile Shop is not responsible for improper installation, improper maintenance, product misuse, incompatible installation materials, or jobsite-specific conditions.

Product Use & Safety
Customers and installers are responsible for determining whether a product is suitable for its intended location and application, including floors, walls, wet areas, exterior applications, commercial installations, pools, fireplaces, or other specialized environments.
Cutting, drilling, grinding, or removing tile, stone, cement-based materials, and masonry products can generate airborne dust. Appropriate professional dust-control practices should be used. Wet cutting is recommended whenever practical, together with suitable ventilation, eye protection, respiratory protection, and other personal protective equipment appropriate for the work being performed.
Zellige is a traditional handmade fired clay tile. Customers purchasing zellige should review the current information concerning handmade glazes, installation safety, and intended use in our Frequently Asked Questions and Installation Guidelines. Zellige is sold as an architectural surface material and is not sold or represented as cookware, serving ware, or a surface intended for direct food preparation or food storage.
Shipping
Shipping charges are the responsibility of the customer unless otherwise stated in writing. Samples and smaller items may ship by parcel carrier. Most tile orders ship by common carrier using LTL freight service.
Freight deliveries are generally curbside. The customer is responsible for moving the material from the delivery point into the home, business, or jobsite. Additional services requested from the freight carrier, including special delivery, re-delivery, reconsignment, inside delivery, or other accessorial services, may result in additional charges to the customer.
Residential and commercial classifications are determined by the freight carrier. A business operating from a residential property generally does not qualify as a commercial delivery location.

Shipping Damage, Shortages & Incorrect Material
Someone must be present to receive and inspect freight deliveries. Before signing the delivery receipt or bill of lading, inspect the shipment for visible damage and verify the number of pallets, cartons, or other shipping units received.
Any visible damage, shortage, or other delivery discrepancy must be clearly noted on the carrier's bill of lading or delivery receipt before the driver leaves. Photographs and other supporting documentation may be required.
Do not refuse a shipment because of damage, shortages, or incorrect quantities unless specifically instructed to do so by Cement Tile Shop. Accept the shipment, document the issue with the driver, and contact us promptly.
Claims involving shipping damage, shortages, or incorrect material must be reported to Cement Tile Shop within three (3) days of delivery. Failure to document visible freight damage with the carrier at delivery may prevent a successful freight claim.
Freight damage claims are subject to the carrier's requirements. Cement Tile Shop will assist with properly documented claims in accordance with our Shipping & Return Policy.
Order Lead Times & Project Scheduling
In-stock orders generally ship within 1–2 business days, but order processing and transit times are estimates and may vary based on order size, inventory, carrier schedules, holidays, weather, and other circumstances.
Special-order and custom material commonly requires approximately 8–16 weeks, unless a different estimated lead time is stated for the particular product or order. Production and delivery dates are estimates and are not guaranteed.
Manufacturing delays, carrier delays, port congestion, customs processing, weather, labor disruptions, and other circumstances outside Cement Tile Shop's reasonable control may affect delivery schedules.
We strongly recommend that customers do not schedule installers, demolition, or other time-sensitive project work until all required material has been received, inspected, and determined to be acceptable for installation.
Payment Terms
Payment must be received and cleared before material is released for shipment unless other terms have been agreed to in writing.
A 50% non-refundable deposit may be required for large, special-order, or custom orders before production begins. The remaining balance will be due upon completion of the order and must be paid before shipment is released.
Full payment is required in advance for sample orders and standard online orders unless otherwise agreed in writing.
Order Cancellation
Cancellation requests should be made as soon as possible. Requests made within 24 hours of purchase will be considered, but cancellation cannot be guaranteed once an order has entered processing, been transferred for shipment, or shipped.
Custom and made-to-order material cannot be canceled once production has begun.
Orders that have already shipped are subject to applicable freight charges, return eligibility, and restocking charges described in our Shipping & Return Policy.
Returns
Handmade, custom, made-to-order, special-order, and other non-returnable products are final sale except where Cement Tile Shop has shipped incorrect material or where another remedy is required under applicable law.
Return eligibility varies by product. No return may be made without prior authorization from Cement Tile Shop. Any approved return must receive a Return Merchandise Authorization (RMA) before material is shipped back.
Approved returns must comply with the requirements of our Shipping & Return Policy. Return freight and applicable restocking charges are the responsibility of the customer unless otherwise agreed in writing.
Material that has been cut, altered, installed, used, or otherwise changed from its original condition is not eligible for return.
Sales Tax, Duties & International Orders
Sales tax will be collected where required by applicable law. Customers claiming a tax exemption must provide valid exemption or resale documentation acceptable for the applicable jurisdiction.
For international shipments, prices and freight charges generally do not include import duties, VAT, customs charges, brokerage fees, or other destination-country taxes or fees unless expressly stated otherwise in writing.
Unless otherwise agreed in writing, the purchaser or recipient is responsible for all applicable import duties, taxes, VAT, customs clearance charges, brokerage fees, and other amounts assessed by the destination country or carrier.
Legal
Any controversy or claim arising out of or relating to your purchase, or the relative rights of you and Cement Tile Shop, shall be settled by arbitration in the City of Tampa, Florida, in accordance with the then-existing Florida Arbitration Code. One arbitrator shall be mutually agreed upon by all parties to the arbitration. If all parties cannot agree on a single arbitrator, each party shall choose an arbitrator, who shall in turn select another individual to act as the arbitrator.
This provision will be specifically enforceable. The decision of the arbitrator will be final and binding on the parties, and judgment upon the award rendered may be entered in any court having jurisdiction thereof. The expenses of arbitration will be borne by the losing parties to the proceeding.
These Terms will be governed by the internal laws of the State of Florida, without regard to conflict-of-laws principles. Jurisdiction and venue for any legal proceeding permitted outside arbitration will lie exclusively in the Thirteenth Judicial Circuit in and for Hillsborough County, Florida, or, if in federal court, in the United States District Court for the Middle District of Florida.
Nothing in these Terms is intended to limit any rights or remedies that cannot legally be waived under applicable law.
